The man will spend 5 to 13 years in prison and then 3 years on probation. He must also follow recommendations for treatment and have no contact with the victim and her family. He will be under sex offender supervision and have a lifetime requirement to report his address to the state police.
Police found the man hiding in the 11-year-old girl’s bedroom and wearing her sparkly leggings.
The man, 58, pleaded guilty to attempted sexual assault of a child and burglary and was sentenced to 5 to 13 years in prison.
The judge also ordered him to complete three years’ probation after parole, meaning he will be under court supervision for 16 years.
The judge said he must have a psychosexual evaluation and follow all recommendations for treatment. He was ordered to have no contact with the victim and her family.
He will be placed under sex offender supervision.
Additionally, he faces a lifetime requirement to report his address to state police in order to comply with Pennsylvania’s Sexual Offender Registration and Notification Act.
The investigation began about 2:11 a.m. Aug. 11 when police received a report of a burglary in progress at a residence. A male entered through a window in her 11-year-old granddaughter’s bedroom and touched her.
The girl told police that she saw a man crawling through her bedroom window, a man she referred to as “Mr. Malone.”
“The juvenile stated the male laid down in bed with her and started touching her, but she ran into her grandmother’s room and told her what happened.”
The victim’s grandmother reported she went to her granddaughter’s bedroom and discovered both the bedroom window and screen were wide open.
Police found the man hiding under a blanket, wedged between a wall and the victim’s bed.
“Malone was wearing small, black female leggings with sparkles on them. Those leggings were later identified by the grandmother as the 11-year-old granddaughter’s pants.”
Malone was taken into custody without further incident.
Investigators found a ladder propped up against a back porch of the home which was used by Malone to gain access through the unlocked bedroom window.
“Michael Malone did admit that he was intending to have sex with the victim during this encounter,” Kammerer alleged.
Other charges were dismissed against Malone as part of the plea agreement.
