The Supreme Court will be considering the limits of presidential immunity on Thursday in a groundbreaking case with important consequences for former President Trump, his legal battles, and the 2024 presidential election.
Trump is making a claim that has already been turned down by two lower courts: That even as a former leader, he is still protected from prosecution for official actions he took while in office.
Prosecutors view the new argument as something that would shield presidents from the criminal justice system even after they finish their term.
Sitting on the bench are three conservative judges appointed by Trump — Justices Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett — but the court’s decision could go against assertions from the expected GOP candidate that he should not be prosecuted.
