The judge in charge of the case against former President Trump for interfering in the Georgia election is moving forward with pretrial motions after delays due to scandal in the Fulton County prosecuting office.
Judge Scott McAfee will listen to arguments from Trump’s lawyer, who is expected to claim that the charges in the Georgia election case should be dismissed under the First Amendment because they target Trump’s essential political speech.
The judge is also expected to listen to arguments on two pretrial motions from co-defendant David Shafer, which argue that the former Georgia Republican Party chair acted legally when declaring himself a “duly elected” state elector and signing documents claiming Trump won the state’s 2020 presidential election.
The arguments are set to start at 10 a.m. EDT.
